Being the subject of a complaint before the Tribunal can be stressful. This information outlines what to expect and how to prepare. 

What happens after an application is made to the Tribunal?

Notification

You will receive written notice of the complaint or application usually by first class post marked private and confidential and sent by recorded delivery. If proceedings cannot be served by post, service might be affected by email using the email address held on record for you by the Law Society of Northern Ireland. 

Solicitor members are reminded that they are under a duty to keep the Law Society of Northern Ireland informed of up to date contact details. 

Evidence Submission

You will be given an opportunity to submit any response to the case brought against you by way of a Replying Affidavit. This is usually within 21 days from the date papers were served upon you. You will be asked to complete a Questionnaire which invites you to confirm whether all or part of the Allegations raised against you are admitted.  

An opportunity will thereafter be given to the Applicant to respond by way of Rejoinder Affidavit.    

Hearing Date

Once pleadings have closed, the Tribunal will fix your case for hearing, and you will be given notice of when and where your hearing will take place. At present, hearings are held in The Meeting Space, Second Floor, Law Society House. 

The Hearing

The hearing before the Tribunal takes place in private and is held in person. An audio recording of the hearing will be made and retained by the Secretary to the Tribunal

You do not have to be legally represented, although it is always recommended that you seek advice and guidance from a suitably qualified professional. It is important to note that the Tribunal may proceed with the hearing of your case in your absence. 

Decision

The Tribunal’s decision is usually delivered orally at the end of the hearing however, in more complex cases the decision may be deferred. All parties will receive a handwritten Judgment and Order as soon as practicable after the hearing.
